Design an elevator cab in 3D, keep every version, and come back to it whenever you like.
Aether — Genesis, the Foundry, the ERP and its Elevator Spec Reader (together, “Aether”) — is a private, invitation-only beta. By continuing past this screen you agree to these terms. If you do not agree, do not continue.
Aether and everything in it is owned by Robert Gargiulo, operating as Aether Concepts (“we,” “us”). You are the individual whose email address was invited (“you”). You sign in with your own email, and you are responsible for what is done under your sign-in. You may not let anyone else use your access, including colleagues at your own company: each colleague your company invites signs in with their own email.
A personal, limited, non-exclusive, non-transferable, revocable licence to use Aether to evaluate it, to test it on your company’s own work, and to give us feedback, for as long as we choose to keep your access open. Nothing else is granted. This is not a sale, not a subscription, and not a right you can pass on. Things will change, and some will break.
Aether, its screens, its underlying code and data, the construction rules and catalogues it applies, the drawings, take-offs and readings it produces, and the fact and content of this beta are our confidential information and trade secrets. You agree to:
This obligation continues after your access ends and does not expire.
It does not apply to information you can show was already public, already known to you without restriction, or independently developed by you without reference to Aether. It does not apply to your company’s own material (Section 5), or to a proposal, letter or estimate you make in Aether and send to your own customer for your own job, once you have checked it (Section 9).
You may not, and may not help anyone else to:
You will necessarily receive a copy of the program in your browser in order to run it. Receiving that copy grants you no rights to it beyond running it in your browser during this beta. Retaining, examining, or reusing it is a breach of these terms.
We own Aether and all intellectual property in it, including its methods, rules and catalogues, and the drawings, take-offs, geometry, and other outputs the Foundry generates. You own nothing in Aether, and nothing here transfers ownership of it to you.
Your company’s own material is not ours: the documents you upload, and the findings, tags, notes, estimates, prices and proposals made for your company, belong to your company. Section 8 says what we do with them.
Any feedback, suggestion, idea, correction, or request you give us — through the Feedback button or any other way — may be used by us freely, forever, for any purpose, without payment, credit, or obligation to you. You assign us all rights in it. If you contribute an idea you consider valuable, tell us before you send it, and don’t send it unless we agree in writing first.
You confirm that you have the right to upload each document you give Aether, including any bid documents that carry their own confidentiality terms. You keep the original. Aether does not store an uploaded file past seven days after it is read. During the beta there is no charge. Aether limits how many specs a company can upload in a given time, and may pause an account that uploads specs it has no real business reading.
Aether reads your document with AI. Any service or process Aether may use in reading it uses it only as these terms describe.
What Aether keeps. Aether is interpreting your spec, not warehousing it. The text of the spec stays with your findings, because every finding points at a page and you need to check it against that page. Your specs, findings, tags, notes, estimates and prices belong to your company. Apart from what Aether keeps, your spec is held only for a limited time.
Who sees it. No person at Aether reads your spec or your estimate except to support you when you ask, or to improve the Spec Reader’s accuracy.
What never happens. Your spec, findings and prices are never shown to another company. Spec details may be used for accuracy of future spec reads, but nothing from your spec ever appears in another company’s results. Item names you add may be offered to the shared item list; your costs never leave your company.
Counts and timings. Aether may keep counts and timings (how many specs, how long a read took) to run and improve the service; those carry nothing from inside a spec.
Aether is beta software under active development. The Foundry’s drawings, dimensions, take-offs, and material call-outs are for evaluation only and must not be used for fabrication, procurement, installation, permitting, code compliance, or any other real-world purpose. The Spec Reader’s findings, suggested tags, estimate lines and letters are a first reading made by a machine: they can be wrong, incomplete, or miss what a spec leaves out. Your estimator checks every line before anything is priced, sent or signed. Outputs may be wrong. Nothing Aether produces has been checked by a qualified person, and nothing in it should be relied on for compliance with ASME A17.1 or any other code or standard. You are responsible for independently verifying anything you act on, and we are not responsible for a bid, a contract or a price built on Aether’s results.
Aether is provided “as is” and “as available,” with no warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement. It may be unavailable, may lose your work, and may change or be withdrawn at any time without notice.
To the fullest extent the law allows, we are not liable to you for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost bids, lost data, lost work, or business interruption, arising from your use of Aether. Our total liability to you for any claim will not exceed one hundred dollars ($100).
We may suspend or end your access at any moment, for any reason or none, without notice. On termination you must stop using Aether and destroy any copy, note, screenshot, drawing, or extract of it in your possession — but not your company’s own material, or the documents Section 3 lets you send. Sections 3, 4, 5, 6, 8, 9, 10, 11, and 13 survive.
Money damages would not adequately remedy a breach of Sections 3 or 4, and we may seek an injunction or other equitable relief without posting a bond, in addition to any other remedy.
These terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Bergen County, New Jersey, and you consent to that jurisdiction.
This is the entire agreement about the beta and replaces anything said before it, including the Foundry’s Beta Terms of 2026-09-14. If any part is unenforceable, the rest stands. Our not enforcing something once does not waive it. We may update these terms; when we do, you will be asked to agree again when you next sign in.
By continuing, you confirm you have read and agree to these terms.
